Terms & Conditions
The Below are general Terms & Conditions when working with Unleished Art unless otherwise agreed upon in writing.
Payment Terms
A non-refundable deposit is required to secure all projects. Work will not commence until the deposit has been received.
Final files will be supplied upon receipt of full payment.
Invoices are payable within [7/14] days unless otherwise agreed. Late payments may incur additional fees.
Scope of Work
Project scope will be outlined and agreed upon prior to commencement.
Any additional work outside of the agreed scope will be quoted separately and may affect timelines.
Revisions
The project includes a set number of revision rounds as outlined in the project proposal.
Additional revisions beyond this will be charged at an hourly rate or quoted accordingly.
Timelines & Client Responsibilities
Project timelines are dependent on timely communication and feedback from the Client.
Delays in feedback, content delivery, or approvals may result in adjusted deadlines.
Cancellations & Kill Fees
If a project is cancelled after work has commenced, the deposit is non-refundable.
Any work completed beyond the initial deposit will be invoiced accordingly.
Copyright and Usage Rights when working with Unleished Art​
All copyright and intellectual property rights in the Artwork remain the sole property of Unleished Art. The Client is granted a non-exclusive, non-transferable licence to use the Artwork only for the following purposes:

Inclusion in the children’s book (print and digital formats).

Promotion and marketing directly related to the book (e.g., social media, posters, brochures, websites, advertising, events).

Any additional use (e.g., merchandise such as plush toys, apparel, colouring books, puzzles, stationery, or prints) requires a separate written licence and may be subject to additional fees or royalties.

The Client may not alter, resell, sublicense, or otherwise repurpose the Artwork without prior written consent from the artist. ​
Moral Rights
The Client may not alter the Artwork (e.g., cropping, recolouring, adding elements) in a way that may compromise the integrity of the original work without the Illustrator’s written consent.
Portfolio Rights
The Illustrator retains the right to display the Artwork in their portfolio, website, social media, and marketing materials, even after the book’s publication. ​
Indemnity & Liability
The Client agrees to indemnify and hold harmless Unleished Art from any claims, damages, or disputes arising from the Client’s use of the Artwork outside the scope of this agreement.
File Delivery
Final artwork files will be supplied in the formats outlined in the project agreement.
Working files (e.g., layered Illustrator or Photoshop files) are not included unless agreed upon in writing.
Third-Party Use
The Client is responsible for ensuring they have appropriate licences for any third-party assets supplied (e.g., fonts, stock images, copy).
Print & Production
Unleished Art is not responsible for print or production errors once files have been approved by the Client.
If print management is included, reasonable care will be taken to ensure quality, but final responsibility lies with the supplier.
Communication
Unleished Art operates during standard business hours. Response times may vary depending on workload, but all efforts will be made to respond promptly.
Force Majeure
Unleished Art is not liable for delays or failure to perform due to circumstances beyond reasonable control (e.g., illness, natural events, technical issues).
Original Artwork
Where original physical artwork is supplied, ownership transfers to the Client only upon full payment. Copyright remains with Unleished Art unless otherwise agreed
